The law appears to require it by bandfather

which I think is why everyone else is doing it this way too. It has been held by the court that student athletes have the right to profit, and there is not too much guidance contained within the decision as to how that should occur. The main holding is that the restrictions imposed by the NCAA were not proper. In the absence of specific guidance, schools are now leaning toward allowing more and limiting less. I don't see anyone but the NCAA contending that too much is being permitted, and I doubt we will hear from them anytime soon. If schools leaned too much the other way, then there would be more parties who would tend to challenge the restrictions. Notre Dame had in place some restrictions, like inability of the student to use the school colors, backgrounds, etc., but those have been modified upon further reflection. From what I have read about the ND student's projects and intentions, they seem to be well thought out, and will not impact on their primary commitments (I have not done any reading about what students at other schools are doing).
