He likely was DUI. Now there is no way to ever prove or charge him with that. Whatever this ends up being will be far less severe. ND also likely can’t take the same action / won’t. Whatever they do will be less.

I don’t know how insurance works - but it’s possible they could have opted out of paying for damage of DUI. For this they probably have to pay.
